In consideration of being allowed to participate in The Strong Like A Mother Pop-Up organized by THIS/MILE in Asbury Park on May 11, 2024, the undersigned participant hereby acknowledges, appreciates, and agrees that:

1. The Activities involve inherent risks and dangers of serious bodily injury, including permanent disability, paralysis, and death, and other dangers associated with running and physical exercise. the Physical Training may be held outdoors on pavement or grass, which carries additional risk, including, but not limited to, those caused by terrain, temperature, weather, environment, lack of hydration and actions of other people, including but not limited to, participants, pedestrians, spectators and instructors.
2. The participant knowingly and freely assumes all such risks, both known and unknown, even if arising from the negligence of the organizers or others, and assumes full responsibility for participation.

3. The participant agrees to comply with all rules and instructions provided by THIS/MILE coaches and organizers regarding the Activities.

4. The participant, for themselves, their heirs, executors, administrators, and assigns, hereby waive, release, discharge, and hold harmless THIS/MILE, Sarah Reinertsen, and Katie Engel, and their respective officers, directors, employees, agents, and volunteers (the "Released Parties") from any and all claims, demands, damages, causes of action, present or future, arising out of or related to any injury, loss, or damage that the participant may sustain while participating in the Activities, whether caused by the negligence of the Released Parties or otherwise.

5. The participant agrees to indemnify and hold harmless the Released Parties from any and all liabilities arising from the participant's participation in the Activities.

6. The participant agrees that this Waiver and Release of Liability shall be binding upon the participant's heirs, executors, administrators, and assigns.

7. The participant agrees that if any portion of this agreement is held invalid, the remainder shall continue in full legal force and effect.

Photography/Video Release

I, the undersigned, hereby expressly acknowledge and agree that participants in the Physical Training may be photographed or videotaped during the Physical Training. The undersigned hereby consents to the use of these photographs and/or videos without compensation, on the Service Provider’s website and/or social media accounts and in any editorial, promotional or advertising material produced and/or published by the Service Provider

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
